Car Accidents and Road Injuries

Car accidents/motor vehicle accidents occur everyday. You could be involved in an accident as either are a driver, passenger, rider, pedestrian or cyclist. The consequences could result in a range of injuries that are minor to severe or catastrophic and might render you incapacitated for work for any length of time.

Lockett McCullough Lawyers Noosa have car accident compensation lawyers available to assist you in conducting a free initial assessment on your compensation claims.

Compulsory Third Party (“CTP”) Insurance

If you have suffered an injury in a car accident, you may be able to make a claim for compensation through the Compulsory Third Party (“CTP”) Insurer for the “at fault” car.

If you know the registration of the “at fault” vehicle, and the owner of the car has paid their registration fees, there is a CTP Insurer.

What if I don’t know the registration or cannot locate the ‘at fault’ vehicle or the registration is not current?

In Queensland, another component of our car registration costs are fees payable to a government CTP Insurer called the “Nominal Defendant”.

The Nominal Defendant is a CTP insurer which handles cases in the following circumstances: –

(a) If you do not know the registration number of the ‘at fault’ vehicle which cause your accident?;

(b) If your injury was caused as a result of a “hit and run” accident;

(c) If the car was not registered.

However, there are additional time limits and hurdles that you need to overcome if you do not know the registration number and the Nominal Defendant will require you to do what is necessary to conduct “proper search and inquiry” to find who caused your accident.

Lockett McCullough Lawyers injury lawyers can give you legal advice on making a  claim against the Nominal Defendant.

During the course of your claim, our experienced compensation and injury lawyers will investigate and gather all evidence about your accident and injury that we need for your claims and will regularly seek updates from you and verify them with you so that we can accurately and thoroughly prepare your case.

After all of the evidence is obtained, our Noosa car accident and injury lawyers can undertake a detailed analysis of your claim for compensation.

Time Limits

If you are injured in a motor vehicle accident, strict time limits apply for making a compensation claim in Queensland.

To start a claim, you must send to the CTP Insurer a Notice of Accident Claim (“NOAC”) form: –

(a) Within one (1) month of consulting a lawyer (this includes the day you speak to a lawyer on the phone about your potential claim); or

(b) Within nine (9) months of the date of your car accident where there is an identified vehicle.

If you can’t or haven’t sent a NOAC within the above timeframes, you may still be able to pursue your claim if you have a “reasonable excuse” for delay and our experienced Noosa injury and compensation team of lawyers can assist you with this.

If the motor vehicle which caused your accident is unregistered or unknown – you must send a NOAC to the Nominal Defendant within 3 months of the date of your motor vehicle incident.

Most importantly, in Queensland you must commence a claim for personal injuries within three (3) years of the date of your injury.

If you are under the age of 18 years when you suffered an injury in a car accident you must commence your claim before your 21st birthday.
