Superannuation and Insurance Claims

If you have suffered an injury, illness or disability, whether it happens in an accident or you simply have unfortunate health issues which means you can’t work as a result, you may be able to make a claim on your income protection insurance and/or for lump sum compensation for Total and Permanent Disability (“TPD”) through your superannuation.

We have 3 offices and service all Queensland area.

What is Income Protection?

If you are sick or injured and cannot work temporarily you may be entitled to claim on your income protection policy.

If your claim is accepted and depending on the content of your policy, the insurers will pay ~75% of your income during the period that your doctor says you are unfit for work.

There are usually waiting periods which apply depending on the policy you hold.

What is Total and Permanent Disability (“TPD”) Insurance?

TPD Insurance is a policy of insurance which entitles you to lump sum compensation if you are sick or injured and cannot return to work.

Usually, to be eligible, you need medical evidence that you are totally and permanently disabled, by reason of your “education, training and experience”: –

(a)    for your own occupation; or

(b)   for any occupation.

If your insurance claims are successful, you can also access your superannuation account balance.

How to Apply?

To make a claim for disability benefits, you should:

  1. Contact your superannuation agency or insurers and ask for the relevant application forms and medical certificate;
  2. Speak to your Doctor and have him/her complete the medical certificate;
  3. Obtain legal advice about making claims on your superannuation policy of insurance.

The Types of Evidence Needed

To pursue a TPD insurance claim, you will need to give us:

  1. A resume or other summary of your previous jobs, including the name of your employer, the period of time you worked for them and a summary of your work duties;
  2. A list of your education and training and copies of those certificates or degrees;
  3. Medical evidence including your complete records and a medical report;
  4. A statement of your employer (usually in the form provided by your superannuation agency);
  5. An independent medical examination – usually with an Occupational Therapist.

After you have submitted all the relevant documentation and evidence to the insurer, the insurer will make a determination. Sometimes, they may want further evidence or require you to undergo a further medical evaluation before they make their final decision.

If your insurance claim is likely to be rejected, the insurer will usually provide you with an opportunity to make further submissions before they make a final determination.
